There are two factors for protection of digital intellectual property, strict copy right laws and technology based protections. Which one do ypu think is more important? Why?
Recently, there has been the exploration of many technical mechanisms intended to protect intellectual property in digital form, along with attempting to develop commercial producers and services based on those mechanisms. From this chapter, we know that there are two factors for protecting digital intellectual property. The one is to strict copyright laws (and strict enforcement), the other is the technology- based protections. Our group members discuss that which factor is more important. In our group discussion, we all think that both of them are not important for the protection of digital intellectual property.
Firstly, all of our group members think that strict copyright laws do not always benefits, and a new survey shows that the copyright laws could even increase risk for authors, and writers in Germany earned less than those in UK, despite the fact the country’s copyright regime is more beneficial to authors. And the study also shows that, despite hopes of internet-prompted resurgence in interest in writing’s writers have not benefited from the growth of the interest as medium. If the writers cannot get benefits from the laws, how can we say it is an important factor for the protection of digital intellectual property.
Secondly, our group thinks that the technology-based protections cannot be the important factor either. The newest technology that attempts to implement DRM(along with other objects) is Microsofts “Trusted Computing” concept, formerly known as “ palladium”. In our group’s thinking, we talk about three essential problems about the technology-based protections. The first problem is that “secure hardware” is never fully secure. The second problem, which is common to all technological attampts at DRM, is that the computer and its accessories are physically in the presence of the adversary. The third problem is that, at some points, the content you have purchased must appear. Because, our group’s thinking that the technology-based protections cannot be the important factor either.
