The court can give the real name of a person who has posted message online to individual, business, or govermnet agency who asks get the real name of a person? or not?
When we discussed this question, we had hard time to decide between protecting privacy or punishing. If I were an individual, business or government agency, I would want to punish the person by myself. However, it could lead to other problems. For example, the person can be beaten by individual, business, or government agency or they can threat the person for paying damage. Therefore, we need to make rule or standard for protecting person from victims and expiating the sin of damaging others. We have decided four rules.
First of all, the most important to think is privacy so we decided not telling the privacy. I think the real name of the person is a part of the privacy. This leads to know person's information such as where he lives, his family, or his working pattern. If they find the person for receiving the cost, it will be fine but they could hurt the person without court order. It will be a huge problem. Therefore, the court does not tell the real name of the person, if it was the first time.
Second, the court can tell the real name of the person, if the person makes them to loss more than ten thousand dollars. Ten thousand dollars is huge money for individual or business. It could ruin them. In addition, they could ask to know the real name of the person when he posted more than twice on purpose. If the person posted the message more than twice, he could try later again. So they need to protect their property by themselves before the person try to post again. If they know the real name of the person, they can remove the account or ban the person to post. It means the court give them to protect their property by themselves.
Finally, even though they know the real name of the person, they cannot judge the person by themselves. They have to follow court order. This is for protecting the right of the person. As mentioned above, they can beat the person or they can threat the person for paying damage. This rule is for the person and preventing other following problems.
Overall, they could not accept decision of a court, but we have to follow the rule for peaceful life.
