David Bertolami CS408-03 Assignment 7

Group 9:Intellectual Property Issues

Topic 1: Digital Rights Management

For as long as I've been citing material for schooling, fair use is a topic that floats around. People are always asking themselves whether or not they are following the rules of fair use, however noone ever actually knows if they are. Companies make it very hard to understand fair use, because what could be fair use with on distributer, might not be okay with another distributer. It's a constant battle, because although you have purchased the rights to use whatever material, but the material is still not yours, technically. If you buy a song, you can turn the music up, and listen to it 1,000,000 times at top volume outside of your house, for everyone to hear. On the other hand, if you put 30 seconds of that song in your informational video on schooling issues, you could get your video removed for infringement. The concept doesn't make too much sense, which is why typical people struggle with the rules set on fair use.

Although numerous problems come from the struggles with fair use, it is in fact only fair that the developers of the material are the only true owners. They only made the material, for the purpose of making the money off of it. There is no reason that they want to just change everything, and instead make their material for free, whether it be music, software, data, etc. The way that I think about this is as follows: If someones develops something, they have all of the rights to it. Because we may want to use other people's work, they might not want that to happen. If they are willing to market their product, which involves leaks, stealing, and money making then they should accept what is going to happen. Although there is going to be revenue made from the people who actually bought the product, there will be someone who gives the product to their friend, meaning that they didn't contribute to revenue.

Although I am an advocate for more fair use, I do not believe that after purchasing materials, they have the right to bypass management restrictions. If people were allowed to do that, online property would be a lot more similiar to, "free software." The difference between the two is that free software is generated for the purpose of being free, and that people can do what they want with the software, because there are no restrictions. Normal software and whatnot however are generated for the purpose of revenue. This means that they are created for two opposite reasons, which causes a problem. Obviously the money makers, don't want to stop making money, and because they made the materials I can see where they are coming from. It would be very convenient for society if everything was free, and we could use whatever softwares we wanted for free, however capitalism doesn't work that way.
