Tony Cuzner CS408(Section 2): Intellectual Property Issues

Group #3 - Patents

Patents have been being used to help protect someone’s work for hundreds of years. In my opinion patents are something that has worked well in doing this and should be used for years to come with maybe a few adjustments. As new technology comes out and new ways to create, capture and share a person’s work are made available. Due to this the patent rules should change to help protect the person in every place where it can be stolen, internet, space, pictures, animations, etc. I feel it is appropriate to use a patent since it lets other people know that the work at hand is in fact yours. It prevents people from stealing other peoples work and in my opinion has prevented a lot of angry people. I feel patents are not always the best way to protect your work due to what can happen before you make one. If someone creates a new pair of sunglasses that tells you the weather and someone else sees it. They could quickly go and patent the idea themselves before the creator who spent all this time has a chance to do so. Patents should be made easier to create to prevent situations like this from happening.

Another adjustment that should be made to the patenting process is the international aspect of it. People and companies should not have to go through the long and expensive process of patenting their idea and product in a bunch of different countries. Patenting laws should be international and apply to every country around the world. This may spark some controversy in the beginning but it will make it easier for companies and creators to secure their work and make them feel that it is actually protected in all fronts and areas of the world. A global patent is definitely something that should be made available to use. I feel the reason piracy of intellectual property is a lot more common outside of the US is because we have the most secure and protected system in making patents, and also the best constructed laws and punishments for disobeying them. Aloes countries that are not as industrialized and modern as the US may not be focused or worried about people stealing other peoples work. This is a difficult task to fix, but if there was a global patent then I believe it would be easier for people around the world to get a patent for their work and make them feel that their work is actually protected.

When it comes to software some countries around the world may have different rules about what is allowed and not. In my opinion a global patent would help fix this. If the rules for creating a patent were made international then in most cases the country’s government would not have a say I the matter. This would make it easier for people to protect their work all over the world, and not just here in the United States. That is why I feel a global patent would help people and companies alike protect their work in countries all over the world.
